Terms of Service
Last updated: October 23, 2026
Welcome to Heirloom. These Terms of Service ("Terms") are a legal agreement between you and Estes Labs LLC, the Indiana company that operates Heirloom ("Heirloom," "we," "our," or "us") that governs your use of the Heirloom mobile application and related services (collectively, the "Service"). By downloading, installing, or using Heirloom, you agree to these Terms. If you do not agree, do not use the Service.
1. Who can use Heirloom
- You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you must have the permission of a parent or legal guardian.
- You agree that the information you provide during onboarding and in your profile is accurate.
- You are responsible for all activity that happens under your account.
2. Your content
"Your Content" means everything you create or upload to Heirloom — storyteller profiles, prompts, video and audio recordings, transcripts, and any other information you add.
- You own Your Content. Heirloom does not claim ownership of the stories, videos, or family information you store in the Service.
- You grant us a limited license to host, store, transmit, display, and back up Your Content solely to operate and improve the Service for you. This license ends when you delete Your Content or your account.
- You are responsible for Your Content. You represent that you have the right to upload it and to share it with the family members you invite, and that doing so does not violate any law or anyone else's rights.
We do not use Your Content to train AI models. We do not sell Your Content. We do not display Your Content to other Heirloom users outside the people you explicitly invite.
3. Invitations and shared viewing
- When you invite a storyteller or a viewer, you represent that you have their consent to be contacted via the phone number or email you provide.
- Invitations are sent through your own device (for example Messages, Mail, or your phone's share sheet). Heirloom does not send invitation messages from our servers.
- Everyone in a family on Heirloom can see that family's stories and prompts. A host can remove a viewer, and a viewer can leave a family at any time.
4. Subscriptions and billing
- Price. Heirloom costs $20 per year per account. Every person who uses Heirloom has their own subscription, including family members you invite. Prices are in US dollars; Apple or Google adds sales tax where it applies.
- Where you pay. Subscriptions are bought inside the app through the Apple App Store or Google Play, using the payment method on your Apple or Google account. Your purchase is also governed by Apple's Media Services Terms or Google Play's Terms of Service. We never see your card number.
- Free trial. New subscribers can get one free month, as offered by the App Store or Google Play, which decide who is eligible. Unless you cancel at least 24 hours before the trial ends, you will be charged $20 and your subscription will start.
- Automatic renewal. Your subscription renews every year at the then-current price unless you turn off auto-renew at least 24 hours before the end of the current period. Apple or Google will tell you before any price increase applies to you.
- Cancelling. Cancel anytime in your phone's subscription settings (iPhone: Settings → your name → Subscriptions; Android: Google Play → Payments & subscriptions), or from the app under Settings → Subscription → Manage. Cancelling stops the next renewal; you keep access until the end of the period you have paid for. Deleting the app or your Heirloom account does not cancel the subscription.
- Refunds. Refunds are handled by Apple or Google under their refund policies (for Apple, reportaproblem.apple.com; for Google, the Google Play refund request page), not by us. If you need help, email support@getheirloomapp.com.
- Failed payments. If a renewal payment fails, Apple or Google will try again for a while. If they still cannot collect it, your access is paused until you update your payment method with them.
- Watch plan. When a family's storyteller has passed away and the family is preserved as a legacy archive, its members can choose a $10-per-year Watch plan, which lets them view that archive but not record or send prompts.
- Complimentary access. Some accounts, such as early testers, have free access. We will give at least 30 days' notice before that ends.
- Your content is kept. If your subscription ends, we do not delete your family's stories. Subscribe again to get access back, or email support@getheirloomapp.com and we will help you get a copy.
5. Acceptable use
You agree not to:
- Upload content that is illegal, threatening, harassing, defamatory, or that infringes someone else's rights.
- Upload content depicting minors in a sexualized manner or that otherwise violates child-safety laws. We report such content to the authorities.
- Impersonate another person or misrepresent your relationship to a storyteller.
- Use the Service to send unsolicited commercial messages or spam.
- Attempt to reverse-engineer, decompile, or extract source code from the app except as permitted by law.
- Interfere with or disrupt the Service, our servers, or our networks.
- Use automated systems (bots, scrapers) to access the Service.
- Use the Service to violate any applicable law.
We may remove content and suspend or terminate accounts that violate these rules. For urgent safety concerns, email safety@getheirloomapp.com.
6. Objectionable content and moderation
Heirloom is a private family app — content is visible only to the people you invite. You can still report objectionable behavior by another Heirloom user (for example, a viewer misusing access) by emailing safety@getheirloomapp.com. We respond as promptly as possible to credible reports and may remove content or terminate accounts as needed.
7. Service availability and changes
- We work hard to keep Heirloom available but do not guarantee uninterrupted service. The Service is provided on an "as-is" basis.
- We may change, suspend, or discontinue features at any time. We will give reasonable notice of material changes that affect how you use the Service.
- We may update the app from time to time. Some updates may be required to keep using the Service.
8. Termination
- You can stop using Heirloom at any time by deleting the app. To delete your account and all associated data, use Settings → Delete Account within the app, or email privacy@getheirloomapp.com.
- We may suspend or terminate your account if you violate these Terms, if required by law, or if we cease offering the Service.
- When your account is terminated, your data will be deleted per our Privacy Policy (typically within 30 days).
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY CONTENT IS ACCURATE OR RELIABLE.
YOU ARE RESPONSIBLE FOR BACKING UP IMPORTANT CONTENT. WHILE WE KEEP REDUNDANT COPIES OF YOUR DATA ON OUR HOSTING PROVIDER, WE CANNOT GUARANTEE AGAINST DATA LOSS.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEIRLOOM AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) USD $100.
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so portions of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold Heirloom harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from (a) Your Content, (b) your use of the Service, or (c) your violation of these Terms or applicable law.
12. App store terms
You acknowledge that these Terms are between you and Heirloom only, not with Apple. Apple is not responsible for the Service or its content. To the extent these Terms conflict with the Apple Media Services Terms for App Store purchases, the Apple terms govern for that purchase. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
If you downloaded Heirloom from Google Play, these Terms are likewise between you and Heirloom only, and Google is not responsible for the Service or its content.
13. Governing law and disputes
These Terms are governed by the laws of the State of Indiana, USA, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Marion County, Indiana, and you consent to personal jurisdiction there.
Nothing in this section limits your rights under consumer-protection laws in your jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced in-app or by email at least 7 days before they take effect. Your continued use of the Service after the change means you accept the new Terms. The "Last updated" date at the top reflects the most recent revision.
15. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Heirloom regarding the Service.
- Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
- No waiver. Our failure to enforce a right is not a waiver of that right.
- Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
16. Copyright (DMCA)
Heirloom respects intellectual property rights. If you believe content on Heirloom infringes your copyright, send a written notice to our designated DMCA agent containing:
- Your physical or electronic signature.
- Identification of the copyrighted work claimed to be infringed.
- Identification of the material to be removed and where it is located in the Service.
